Terms of Use

Last Updated: July 6, 2026

1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of ClaimFile NY, published at workclaimclarity.com (the “Site”), an independent, privately operated educational resource concerning the procedural and paperwork side of New York work injury claims. By accessing or using the Site, you agree to be bound by these Terms in their entirety. If any portion is unacceptable to you, you must stop using the Site immediately.

1.1 Eligibility & Changes to These Terms

You represent that you are at least eighteen years of age or are accessing the Site under a parent or guardian’s supervision. We may revise these Terms at any time by posting an updated version, effective immediately upon posting. Continued use of the Site after a revision constitutes acceptance of the changes described in Section 8 below.

2. Disclaimer of Professional Advice & Limitation of Liability

This is the most important section of these Terms. Please read it carefully.

2.1 Educational Purpose Only

ClaimFile NY is not a law firm and offers no legal representation. Every article, guide, checklist, and form walkthrough on the Site is strictly general educational content meant to help readers understand how New York’s workers’ compensation paperwork and filing process typically operate. Nothing on the Site is legal advice tailored to your circumstances, and none of it substitutes for consulting a licensed attorney or the Workers’ Compensation Board about your specific claim.

2.2 No Attorney-Client Relationship

Reading the Site, submitting a contact form, or receiving a reply from us does not create an attorney-client, fiduciary, or other professional relationship between you and ClaimFile NY. Nothing you send us through the Site should be treated as confidential or privileged, and we will not treat it as subject to attorney-client privilege.

2.3 “As-Is” and “As-Available” Basis

The Site and its content are provided strictly on an “as-is” and “as-available” basis, without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted or error-free, nor that its content reflects the most current state of New York law, which changes frequently through legislation, regulation, and court decisions.

2.4 Limitation of Liability

To the fullest extent applicable law permits, ClaimFile NY, its owners, operators, contributors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages — including lost wages, denied or delayed benefits, or missed filing deadlines — arising from your use of, reliance on, or inability to use the Site or its content, even if advised of the possibility of such damages. This limitation applies regardless of legal theory and represents an absolute allocation of risk to the user to the maximum extent the law allows.

3. Intellectual Property

All text, graphics, layouts, compilations, and other original material appearing on the Site are the property of ClaimFile NY or its licensors and are protected under applicable copyright and other intellectual property laws.

3.1 Permitted Personal Use

You may view, download, and print individual pages of the Site solely for personal, non-commercial reference in connection with understanding your own workers’ compensation matter.

3.2 Restrictions on Republication & Resale

Except as permitted in Section 3.1, you may not republish, redistribute, mirror, sell, license, or otherwise commercially exploit Site content without our prior written permission. This includes reposting our articles elsewhere, incorporating our text into paid products or services, and reproducing substantial portions of our content in any medium.

3.3 Automated Access, Scrapers & AI Crawlers

You may not use bots, scrapers, or other automated means to extract, harvest, or bulk-download Site content, and you may not use our content to train, fine-tune, or otherwise develop artificial intelligence or machine-learning models, directly or through an automated crawler, without our prior written permission. We reserve the right to block or take other measures against any automated agent that disregards this restriction.

4. Third-Party Links & Referrals

The Site may link to government portals, insurer resources, or independent third parties such as workers’ compensation attorneys or claims-assistance providers, and may facilitate voluntary referrals to such parties at your request. We do not control these third parties, do not warrant their services, and are not responsible for the content, accuracy, or conduct of any linked site or referred provider. Any engagement you enter into with a referred third party is strictly between you and that party, governed by their own terms rather than these Terms.

5. Prohibited Uses

In using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of applicable law;
  • Attempt to gain unauthorized access to the Site’s systems, servers, or non-public areas;
  • Introduce viruses, malware, or other harmful code to the Site;
  • Impersonate any person or entity in communications made through the Site;
  • Interfere with or disrupt the Site’s operation or availability to other users; or
  • Use Site content in a manner that violates Section 3 of these Terms.

6. Indemnification

You agree to indemnify, defend, and hold harmless ClaimFile NY, its owners, operators, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your use of the Site, your violation of these Terms, or your violation of any third party’s rights.

7. Severability

If a court of competent jurisdiction finds any provision of these Terms invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be so modified. The remaining provisions shall continue in full force and effect.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be reflected by updating the “Last Updated” date above. Continued use of the Site after a posted change constitutes acceptance of the revised Terms.
